Unpaid commission following the sale of six sport horses
Schelstraete Lawyers successfully represented Olympic rider Inna Logutenkova in legal proceedings concerning unpaid commissions arising from the sale of six sport horses.
Under a training agreement, Ms Logutenkova trained six horses owned by the former owner of an equestrian training centre in the Netherlands. The objective of the agreement was to prepare at least one of the horses for participation in the Tokyo 2020 Olympic Games.
The parties further agreed that Ms Logutenkova would receive a commission equal to 10% of the purchase price if any of the horses were sold. Without informing Ms Logutenkova, the owner sold all six horses and subsequently refused to pay the agreed commission.
Binding agreement on commission
Before the court, the owner argued that any contractual relationship with Ms Logutenkova had ended upon the sale of the horses and that no commission was payable. The court rejected that position. It found that the parties had entered into a binding agreement concerning the payment of commission and that the owner remained obliged to honour those contractual obligations after the sales had taken place.
Recovery of the outstanding commission
To secure our client’s position, Schelstraete Equine Law obtained prejudgment attachments over the former owner’s assets.Following the court’s judgment, the outstanding commissions were paid to Ms Logutenkova in full.
