Dutch Court Refuses Recognition of U.S. Judgment Awarding Punitive Damages

Schelstraete Lawyers represented a Dutch client in summary proceedings before the District Court of Amsterdam concerning the recognition and enforcement of a judgment rendered by a court in Tennessee, United States.

The American judgment awarded both compensatory damages and punitive damages. The claimant sought to rely on that judgment in the Netherlands and had obtained prejudgment attachments against our client’s assets.

On behalf of our client, Schelstraete Equine Law argued that the foreign judgment could not be recognised and enforced under Dutch law. The District Court of Amsterdam granted our client’s application in the summary proceedings and ordered that the prejudgment attachments be lifted.

Recognition and enforcement of foreign judgments

The enforcement of foreign judgments in the Netherlands depends on the applicable legal framework, including international treaties, European legislation and Dutch private international law. Courts assess whether a foreign judgment satisfies the legal requirements for recognition and whether enforcement would be compatible with Dutch public policy.

One important distinction concerns punitive damages. While punitive damages may be available under certain legal systems, including parts of the United States, Dutch civil law is fundamentally compensatory in nature. Dutch courts generally award compensation for proven loss rather than damages intended to punish or deter.
